Senate Faces Critical Moment After House Passage of SAVE America Act
Arlington, Va. — Feb. 12, 2026 — Following House passage of the Safeguard American Voter Eligibility (SAVE) Act (H.R. 22), (aka the “SAVE America Act”), the Election Transparency Initiative (ETI) urged the United States Senate to act immediately to advance and pass the legislation, calling the present moment a critical opportunity to establish clear citizenship verification standards for federal elections, along with the universally popular voter identification requirement.
“The House has done its job. The Senate must now act — and act without delay,” said ETI Chairman Ken Cuccinelli. “This is a rare and critical opportunity to establish clear citizenship verification standards for federal elections, and to clean up the federal requirement for voter I.D. If the Senate fails to seize this moment to advance the SAVE America Act, the political window to enact this commonsense protection may close, leaving a preventable vulnerability in our election system. Americans from all walks of life understand that this legislation does not disenfranchise eligible voters — it safeguards the lawful vote of every American citizen. The American people — Republicans, Democrats, and independents alike — overwhelmingly support citizen-only voting and voter I.D., and they expect their elected officials to enact these common-sense protections.”
The SAVE America Act would amend the National Voter Registration Act to require documentary proof of U.S. citizenship when individuals register to vote in federal elections, and it would amend the Help America Vote Act to require a photo I.D. to vote in federal elections. The legislation establishes clear baseline safeguards while preserving states’ primary authority to administer elections.
“In recent years, record levels of unlawful migration have placed unprecedented strain on public systems and heightened the importance of maintaining clear and enforceable eligibility standards,” Cuccinelli said. “Americans deserve to have their legitimate vote protected from being diluted by illegal votes or voters. The SAVE America Act provides that certainty.”
Cuccinelli emphasized that citizen-only voting and requiring voter I.D. are not partisan issues, but are broadly shared national expectations.
“This legislation reflects a basic principle of democratic self-government,” Cuccinelli added. “The Senate should move swiftly to invoke cloture, advance the bill, and demonstrate to the American people that protecting the integrity of federal elections remains a national priority.”
